Welcome to Mushy™ home of the Mushybar™! These Terms and Conditions (“Terms”) govern your use of our website Mushybars.com  (the “Website”) and your purchase of our legal mushroom chocolate products. By using our Website or placing an order, you agree to these Terms. If you don’t agree, please do not use our Website.

1. Eligibility

  • Our Website and products are intended for individuals aged 18 and older.

  • By placing an order, you confirm you are at least 18 and comply with all applicable laws in your jurisdiction.

  • We reserve the right to refuse service to anyone who does not meet these requirements.

2. Orders and Payments

  • Order Acceptance: All orders are subject to our approval. We may cancel or limit orders for any reason, such as product availability or suspected fraud.

  • Pricing: Prices are listed in USD and may exclude taxes or shipping fees, which will be added at checkout.

  • Payment: We accept payments via credit cards, PayPal, Venmo.  You agree to provide accurate payment information.

  • Errors: We may correct pricing errors or cancel orders affected by such errors.

3. Shipping and Delivery

  • We ship to the United States. Shipping times and costs are provided at checkout.

  • Delivery times are estimates and not guaranteed. We are not responsible for delays caused by carriers or customs.

  • You are responsible for providing a correct shipping address. We are not liable for lost or undelivered packages due to incorrect addresses.

4. Returns and Refunds

  • Returns: We accept returns of unopened, unused products within 90 of delivery, subject to our approval.

  • Refunds: Approved refunds will be processed to your original payment method within 7-10 business days. Shipping costs are non-refundable.

  • Damaged or Defective Products: Contact us at info@mushybars.com within 7 days of delivery if your order arrives damaged or defective.

  • Non-Returnable Items: Opened or used products cannot be returned unless defective.

5. Product Use

  • Our mushroom chocolate products are made with legal, non-psychoactive ingredients.  Functional Mushrooms from one of Americas leading suppliers.  They are USDA Organic.  You agree to use them only as directed and in compliance with local laws.

  • Consult a healthcare professional before using our products, especially if you have medical conditions or are taking medications.

  • We are not responsible for adverse effects from improper use or failure to follow instructions.

6. Intellectual Property

  • All content on our Website (e.g., logos, images, text) is owned by Colorado Shroomery LLC. or our licensors. You may not copy, distribute, or use it without our permission.

7. Limitation of Liability

  • Our products and Website are provided “as is.” We do not guarantee that they will meet your expectations or be error-free.

  • To the fullest extent allowed by law, Mushy™ is not liable for any indirect, incidental, or consequential damages (e.g., lost profits, health issues) arising from your use of our Website or products.

  • Our total liability for any claim is limited to the amount you paid for the product in question.

8. Governing Law

  • These Terms are governed by the laws of Colorado, USA. Any disputes will be resolved via mediation in Denver, Colorado.

9. Changes to These Terms

  • We may update these Terms at any time. Changes will be posted on our Website with a new “Effective Date.” Your continued use of the Website means you accept the updated Terms.
